Terms of Use
Last updated October 26, 2026
These Terms of Use (the "terms") are a binding agreement between you and Worth A Try LLC ("Worth A Try", "we" or "us"), the maker of Eagerness. They cover the Eagerness app for Mac, its download helper, the AI models it downloads, its updates, and our website and store (together, "Eagerness").
You accept these terms when you click a button or check a box that refers to them, download, install or use Eagerness (including the free trial), or buy a license. If you don't agree, don't use Eagerness.
Please read section 17 carefully. Unless you live in the EU, EEA, UK or Switzerland, it requires binding individual arbitration instead of court, and it waives class actions and jury trials. You can opt out within 30 days (section 17.10).
1. Who can use Eagerness
You may use Eagerness only if:
- you are at least 18 and an adult under the law where you live;
- you are not located or ordinarily resident in a country or region under comprehensive US sanctions, and are not on, or acting for anyone on, a US government list of restricted persons; and
- using Eagerness is legal where you are.
By using Eagerness, you confirm this. Don't let anyone under 18 use it; you are responsible for anyone who uses it on your Mac or with your license key.
2. What Eagerness is
Eagerness is a voice AI for Macs with Apple silicon. You talk to it out loud or type, and it answers in a natural-sounding AI voice. Its AI models run entirely on your Mac. It includes four fictional AI characters: Ava, Leo, Mia and Max. There are no user accounts, and we don't host your content.
You need a Mac that meets the requirements on our website. Which features you can use depends on your Mac, and AI models use a lot of memory, storage and battery.
3. What to expect from AI replies
Replies in Eagerness are generated automatically by AI software on your Mac. Nobody at Worth A Try writes, reviews or moderates them, and we can't see them.
- Replies can be wrong. They may be inaccurate, incomplete, out of date or made up, even when they sound sure. Check anything important before you rely on it.
- Replies can be upsetting. Eagerness follows your lead, and its replies may be mature, offensive, biased or upsetting. It's your choice whether to keep talking.
- You are talking to software. Ava, Leo, Mia and Max are AI characters, not real people, and have no real feelings, even when they sound like it. What they say is not a statement or promise by Worth A Try.
- It is not professional advice. Eagerness is not a doctor, therapist, counselor, lawyer or financial adviser, or a substitute for one, and it is not a medical device.
- It is not an emergency or crisis service. Eagerness can't call for help, and we can't see what you tell it. If anyone is in danger, call 911 in the US or your local emergency number. If you are thinking about suicide or self-harm, call or text 988 in the US to reach the 988 Suicide & Crisis Lifeline, or contact a local crisis line.
If Eagerness notices talk of suicide or self-harm, it asks the AI to answer with care and to say how to reach crisis help, as our Safety page describes. It can miss things or misread them, and it never alerts anyone.
If Eagerness ever makes you feel worse, stop and reach out to people you trust or to a professional. You use Eagerness and its replies at your own risk.
4. Your responsibilities
You are responsible for what you say to Eagerness, what you do with its replies, anything you keep or share, and following the laws that apply to you. You agree not to use Eagerness, or help anyone else use it, to:
- break any law, or plan, encourage or carry out violence or other harm;
- create, request or share anything that sexualizes, exploits, abuses or endangers minors, real or fictional;
- harass, threaten, stalk or defame anyone, or violate anyone's privacy, publicity, intellectual property or other rights;
- impersonate a real person, or use its output to deceive or defraud anyone, for example by passing it off as a real person or as coming from us, or in scams or disinformation;
- rely on it where a mistake could cause death, injury or serious harm, such as for medical, legal, financial or safety decisions;
- build, train or improve a product or AI model that competes with Eagerness, including with its output; or
- get around its license or trial checks.
We can't monitor how you use Eagerness, but if we learn that you have broken this section, we may end your license.
5. Free trial
You can try Eagerness free for the conversation time shown on our website and in the app (currently 20 minutes). During the trial, we grant you a personal, non-exclusive, non-transferable license to use Eagerness on your Mac to evaluate it, subject to these terms, including section 6.5. After that, you need a license to keep talking. We may change or end the trial at any time; that won't affect a license you have bought.
6. Your license
6.1 License. When you buy Eagerness and we issue your license key, we grant you a personal, non-exclusive, non-transferable, non-sublicensable license to install and use Eagerness on the one Mac your key was issued for, for your own personal use, subject to these terms. The license doesn't expire, but it can end under these terms. Eagerness is licensed, not sold, and we reserve all rights not expressly granted.
6.2 One Mac. Your key is signed for one Mac and tied to a device code made from that Mac's details, normally its hardware identifier. Each license covers one Mac. You may not share, publish, sell, rent, lend or give away your key, or use it, or let anyone use it, on another Mac. A license doesn't go with a Mac you sell or give away. Keep your key private: it contains your email address.
6.3 Moving to a new Mac. If you replace your Mac, email us and we will move your license to the new one free of charge. Moves are at our reasonable discretion: we may ask for proof of purchase, limit how often a license is moved, and decline a move we believe is an attempt to share, sell or transfer a license. We can move a license only while we still hold its purchase record. After a move, your old Mac is no longer covered.
6.4 Backups. You may copy Eagerness in ordinary backups of your Mac, such as Time Machine, as long as you use it only on the Mac your license covers.
6.5 Restrictions. "Our software" means Eagerness other than its open-source components. Except to the extent the law or an applicable open-source license gives you the right despite this section, you may not, and may not help anyone else to:
- copy, modify, translate or make derivative works of our software, except backups under section 6.4;
- reverse engineer, decompile or disassemble our software, or try to discover its source code;
- remove, bypass or tamper with the license check, device binding, trial limit or any other technical protection, or reset or extend the trial;
- make, alter, sell, share or use a license key that we didn't issue to you;
- sell, rent, lend, sublicense or distribute Eagerness, or make it available to others, including as a service; or
- remove or change any copyright, trademark or license notice in Eagerness.
6.6 Open-source components. Eagerness includes open-source software and AI models made by others, for example under the Apache License 2.0 and the MIT License. Each is licensed to you under its own license, which governs your use of it. Nothing in these terms limits any right those licenses give you or adds any restriction they forbid; if these terms conflict with one of them, that license controls for that component. Copies of those licenses come with Eagerness (Help › Acknowledgements), and we'll email them on request.
6.7 When your license ends. Your license ends automatically if you share, sell, publish or transfer your key, use it on a Mac it doesn't cover, or break section 6.5. We may also end it by email if you seriously or repeatedly break these terms, and it can end under sections 8 and 9. When it ends, you must stop using your key and the paid version of Eagerness. If it ends because you broke these terms, you get no refund, except where the law requires one.
7. Price and payment
Eagerness is a one-time purchase, not a subscription, at the price shown in the app and at checkout (currently US$99), plus any tax shown at checkout. You pay in your browser through Stripe Checkout; Stripe processes your payment under its own terms, and we never see your full card number. Use only a payment method you are authorized to use. When your payment is confirmed, we issue your license key.
We may not sell licenses in every country, and we currently don't sell them in the EU, EEA, UK or Switzerland. Don't buy a license from, or for use in, a country where we don't offer one.
We may change our price or run promotions at any time, but never for a purchase already made: we won't charge you again for a license you have, and a later lower price doesn't entitle you to a partial refund.
8. Refunds
14-day money-back guarantee. Email us at support@eagerness.ai within 14 days after the day you buy, and we will refund the full amount you paid. You don't need to give a reason; just write from the address you bought with, or include your purchase details. Refunds go back to your original payment method.
A refund ends the license it refunds, and you must stop using that key. After 14 days, purchases are final, except where the law gives you a right to a refund or other remedy. This guarantee adds to your legal rights and is not a warranty about how Eagerness performs.
9. Chargebacks and fraud
If you think a charge is wrong, contact us first; within the 14 days, we will refund you anyway. If a payment is charged back or otherwise reversed, we may end the license it paid for. We may also refuse an order, or revoke a license, that we reasonably believe was obtained by fraud, with a payment method the buyer wasn't authorized to use, or in breach of these terms. This doesn't limit any legal right you have to dispute a charge.
10. Updates, downloads and availability
Updates. We may release updates, and an update may add, change or remove features. Your purchase includes every version 1 update (1.x) that we choose to release, free. We don't have to release any particular update. A future major version, such as version 2, may be sold separately; you can keep using the version you have. We may stop supporting older versions.
Connections to our servers. The Eagerness download helper connects to our servers, which run on Cloudflare, to download AI models when you set Eagerness up or switch models, and each time you open Eagerness to check for a newer version. Downloads can be many gigabytes, and any data charges are yours.
Availability. We intend to keep model downloads available for as long as we sell Eagerness, but we can't promise they always will be, or that Eagerness will keep working with future versions of macOS or future Macs. If you rely on it, keep it and its models installed and backed up. If we stop selling Eagerness, licenses already bought continue for the versions their owners have.
11. Privacy and your Mac
Eagerness processes your voice and conversations on your Mac, and we don't receive them or what it remembers about you. We receive limited information when you buy, when the download helper connects to our servers and when you email us, as our Privacy Policy explains. Protecting your Mac is up to you: anyone who can use it may be able to use Eagerness and see what it remembers, and we can't recover anything lost or erased.
12. Ownership, your words and feedback
Our rights. Except for its open-source components, Eagerness, including its software, the AI models we own, and its voices, characters, designs and text, belongs to Worth A Try LLC or its licensors. Eagerness, Worth A Try and our logos are our trademarks; don't use them without our written permission, except to refer to our products accurately.
Your words and the app's replies. What you say to Eagerness is yours. As between you and us, we claim no ownership of its replies to you, and you may use them for any lawful purpose consistent with these terms. But replies may not be unique, protected by copyright or free of anyone else's rights, and you are responsible for how you use them.
Feedback. If you send us ideas or other feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free, transferable and sublicensable license to use it for any purpose, without obligation to you.
13. No warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, CONFIDANT, INCLUDING ITS REPLIES, MODELS, VOICES, UPDATES AND DOWNLOADS, IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. WORTH A TRY, FOR ITSELF AND ITS LICENSORS AND SUPPLIERS, DISCLAIMS ALL WARRANTIES AND CONDITIONS, EXPRESS, IMPLIED OR STATUTORY, INCLUDING OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, QUIET ENJOYMENT AND NON-INFRINGEMENT, AND ANY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT CONFIDANT OR ITS REPLIES WILL BE ACCURATE, APPROPRIATE, SAFE, SECURE, UNINTERRUPTED OR ERROR-FREE, THAT IT WILL MEET YOUR NEEDS OR RUN ON YOUR MAC, OR THAT DOWNLOADS WILL REMAIN AVAILABLE. IF THE LAW DOESN'T ALLOW US TO DISCLAIM AN IMPLIED WARRANTY, IT LASTS ONLY 14 DAYS AFTER YOU BUY, OR THE SHORTEST PERIOD THE LAW ALLOWS IF LONGER.
14. Limits on our liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER WORTH A TRY LLC NOR ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS OR SUPPLIERS (THE "WORTH A TRY PARTIES") WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES; ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR OPPORTUNITY; OR ANY HARM ARISING FROM CONFIDANT'S REPLIES OR YOUR RELIANCE ON THEM, EVEN IF TOLD THESE DAMAGES WERE POSSIBLE.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WORTH A TRY PARTIES' TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO CONFIDANT OR THESE TERMS, UNDER ANY THEORY (INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY AND STATUTE), WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR CONFIDANT AND (B) US$50. THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
These limits don't apply to liability that the law doesn't allow to be limited or excluded, which, depending on where you live, may include liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by negligence. The price of Eagerness reflects these limits.
15. Indemnity
To the extent permitted by law, you will defend, indemnify and hold harmless the Worth A Try Parties against any third-party claim, and resulting losses, liabilities, settlements and costs (including reasonable attorneys' fees), to the extent it arises from (a) your use or misuse of Eagerness, or anyone's use of it on your Mac or with your key; (b) anything you create, publish or share with its replies; (c) your breach of these terms; or (d) your violation of any law or anyone's rights, but not to the extent it is caused by our own breach of these terms, negligence or misconduct. We may take over the defense of such a claim, and you will cooperate and not settle it without our written consent.
16. Ending
You may stop using Eagerness at any time by deleting it, and your license can end under sections 6.7, 8 and 9. We may stop offering Eagerness, the trial or model downloads at any time (see section 10). Sections 3, 4, 6.5 to 6.7, 7 to 9 and 11 to 19 survive the end of your license or these terms.
17. Disputes, arbitration and class-action waiver
This section applies as far as the law allows, but not to consumers who live in the EU, EEA, UK or Switzerland (see section 18). A "Dispute" is any dispute, claim or controversy between you and any Worth A Try Party relating to Eagerness, our website or store, any purchase or these terms, under any legal theory, including one that arose before you accepted these terms.
17.1 Talk to us first. Before starting an arbitration or court case, the party with a Dispute must send the other a written notice (a "Notice of Dispute") and try in good faith to resolve it for 60 days. Send yours to support@eagerness.ai; we will use the email address you bought with or wrote from. A Notice of Dispute must give the sender's name and contact details, the Dispute and the relief sought, and must be personally signed by the person bringing it. If either of us asks, we will hold an individual settlement call within the 60 days, which you must join personally (a lawyer may join too). Limitation periods are paused during this process. It is a condition of starting a case, except under 17.4(b), and a court may enforce it.
17.2 Binding individual arbitration. If the Dispute isn't resolved, you and we will resolve it only by binding individual arbitration, except as 17.4 allows. There is no judge or jury and court review is limited, but the arbitrator can award the same individual relief a court could and must follow these terms. The Federal Arbitration Act (the "FAA") governs this section; if it doesn't apply, Delaware arbitration law does.
17.3 Rules, hearings and fees. The American Arbitration Association (the "AAA") will administer the arbitration under its Consumer Arbitration Rules and, where they apply, its mass arbitration rules, as modified by this section (see adr.org). If the AAA can't or won't, JAMS will. Any in-person hearing will be in the US county where you live, unless we both agree otherwise. Fees are paid as the AAA's consumer rules provide, which limit what you pay, and if the arbitrator finds the cost would be prohibitive for you compared with court, we will pay as much as needed to prevent that. Each side pays its own lawyers unless the law lets the arbitrator award fees, and the arbitrator may award fees and costs against a party whose claim or defense is frivolous or improper under the standard of Federal Rule of Civil Procedure 11(b). The award binds only its parties, and any court with jurisdiction may enter judgment on it.
17.4 Exceptions. Either of us may instead (a) bring an individual claim in small claims court, as long as it stays there; or (b) ask a court to stop actual or threatened infringement or misuse of intellectual property, including copying our software or getting around its license or trial checks.
17.5 No class actions or jury trials. YOU AND WE MAY BRING CLAIMS AGAINST EACH OTHER ONLY INDIVIDUALLY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. EXCEPT AS 17.6 PROVIDES, THE ARBITRATOR MAY NOT COMBINE DIFFERENT PEOPLE'S CLAIMS OR PRESIDE OVER ANY CLASS OR REPRESENTATIVE PROCEEDING, AND MAY AWARD RELIEF ONLY TO THE INDIVIDUAL PARTY SEEKING IT AND ONLY AS NEEDED FOR THAT PARTY'S OWN CLAIM. THIS APPLIES IN ARBITRATION AND, AS FAR AS THE LAW ALLOWS, IN COURT. AS FAR AS THE LAW ALLOWS, YOU AND WE ALSO WAIVE ANY RIGHT TO A JURY TRIAL.
17.6 Mass filings. If 25 or more similar demands are brought against us, or by us, by or with the help of the same or coordinated lawyers or organizations, the AAA's mass arbitration rules apply, and the demands will be administered in batches of up to 100, with one arbitrator per batch and batches proceeding at the same time unless the parties agree otherwise. Each claim is still decided individually, and no result binds another claimant. Fees will be charged per batch where the AAA's rules allow. Limitation periods are paused for each claim from its Notice of Dispute until its batch is filed. A court may enforce this paragraph.
17.7 Public injunctive relief. If a claim seeks public injunctive relief and a court rules that this section can't require that relief to be arbitrated or waived, a court will decide that request after the individual claims are arbitrated, and the court case will be paused until then.
17.8 Who decides. The arbitrator decides all disputes about the scope, validity and enforceability of this section, except that a court decides disputes about 17.1, 17.5, 17.6 and 17.7.
17.9 If part of this section is unenforceable. If a court finds the waiver of class, collective or representative proceedings in 17.5 unenforceable for any claim or part of a claim, that claim or part will be severed and decided by a court, never in a class arbitration, after the individual claims are arbitrated. If any other part of this section is unenforceable, the rest still applies.
17.10 Opting out. You may opt out of arbitration by emailing support@eagerness.ai within 30 days after you first accept these terms, with your name, the email address you bought with (if any) and a clear statement that you opt out of arbitration. Each person must opt out individually. If you opt out, 17.2, 17.3, 17.6 and 17.8 don't apply to you, but the rest of these terms does, including 17.1 and, as far as the law allows, 17.5.
17.11 Changes to this section. A change to this section won't apply to a Dispute that either of us gave notice of before the change took effect, and you may reject such a change by emailing us within 30 days after it takes effect, in which case the version you last accepted still applies.
17.12 Courts. Any Dispute that isn't arbitrated will be decided only in the state or federal courts located in Delaware, except small claims cases, and you and we consent to those courts' personal jurisdiction and venue.
18. Consumers outside the US
Your local rights. If you are a consumer, nothing in these terms limits rights that the law where you live doesn't let a contract take away, and any term that conflicts with them doesn't apply to you to that extent.
EU, EEA, UK and Swiss consumers. If you live in one of these places and use Eagerness as a consumer:
- Section 17 doesn't apply to you. You may sue us in the courts where you live, and we may sue you only there.
- Delaware law applies, but you keep the protection of the mandatory laws of the country where you live.
- You keep your legal rights for digital content, including remedies if Eagerness is faulty or not as described and, where the law provides, updates needed to keep it working as described. Sections 10, 13 and 14 don't limit those rights.
- Instead of section 14, we are responsible for loss that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill, but not for unforeseeable loss or, since Eagerness is for personal use, loss of profit, business or business opportunity. We don't exclude or limit liability for death or personal injury caused by our negligence, for fraud, or where the law doesn't allow it.
- Right of withdrawal. Where the law gives you a right to withdraw from a purchase of digital content (in the EU, EEA and UK, normally 14 days), by buying a license you ask us to supply Eagerness right away, and you acknowledge that you lose that right once we issue your license key. Our 14-day money-back guarantee in section 8 still applies to you.
19. General terms
Governing law. The laws of the State of Delaware, USA, govern these terms, without regard to conflict-of-law rules, and the FAA governs section 17. The UN Convention on Contracts for the International Sale of Goods doesn't apply.
Changes to these terms. We may change these terms for valid reasons, such as changes to Eagerness, the law or our business, and will post the new version here with a new date. We will give at least 30 days' notice of a material change on our website and, where we can, in the app or by email, unless the law requires it sooner. If you keep using Eagerness after a change takes effect, the new terms apply; if you don't agree, stop using it. A change won't apply retroactively, take away a license you have paid for, or apply to a Dispute that either of us gave notice of before it took effect.
Notices. We may communicate with you electronically, including by email, in the app or on our website, and that satisfies any legal requirement to be in writing. Notices to us take effect when received at support@eagerness.ai.
Assignment. You may not assign or transfer these terms, your license or any claim against us, except through a license move under section 6.3; any attempt is void. We may assign these terms, for example in a merger or sale of assets, if that doesn't reduce your rights under them.
Force majeure. We aren't responsible for delays or failures caused by events beyond our reasonable control, such as outages at our providers, cyberattacks, natural disasters or government action.
Export. Eagerness is subject to US export control and sanctions laws, and you may not export, re-export or transfer it in violation of them.
Everything else. If any part of these terms is unenforceable, it will be enforced as far as the law allows and the rest stays in effect, except as section 17.9 provides. Not enforcing a part isn't a waiver of it. These terms are the entire agreement between you and us about Eagerness and replace any earlier one. Only you, we and the Worth A Try Parties have rights under them. "Including" means "including without limitation".
